This is a quote from the writing of Supreme Court Justice J. Stephens,who said in his dissenting opinion in "Deal v. United States (113S.Ct.at 2003-4 n. 10). "Punishing first offenders with 25-year sentences does not deter crime as much as it ruins lives. If,after arrest and conviction,a first offender is warned that he will face a manditory 25 year sentence if he commits the same crime again,then the offender wil know of the penalty. Having already served at least five years in prison,he will have a strong incentive to stay out of trouble. Discouraging repeat offences by people who have already been in prison and have been released serves a far more valuable purpose than deterring offenders who have yet to be arrested and have no knowledge of the laws and penalties. - Bill's comments: "Well said! If only the rest of the court was so enlightened!! Perhaps it's time to rethink the old "Ignorance of the law is no excuse'. Maybe give it some meaning that with so many laws and guidelines,no one really knows absolutely all of the laws, statues,and cases.
